3 common causes of construction litigation

Frequently, construction projects involve many moving parts that rely on cohesion to complete tasks effectively. Unfortunately, disputes can often arise. 

Construction disputes can result in significant financial losses for all parties involved. Therefore, quickly resolving them is typically in everyone’s best interests. Identifying the common sources of dispute is an important part of preventing and resolving disagreements. Outlined below are three common causes of construction litigation. 

Workplace injuries

Even when special care has been taken to implement safety procedures, workplace accidents can still occur. It often takes considerable time to identify who, if anyone, was at fault for the accident. This may lead to a considerable delay in any work being carried out as well as potential litigation. 

Unexpected delays

There are a number of factors that may lead to delays in construction work. For example, poor weather conditions could mean that work simply cannot be conducted safely. Additionally, many tasks require specific permits and materials, which might not always arrive in a timely manner. Extended delays in construction projects can also lead to litigation. 

Subpar work

Occasionally, building work is not fulfilled to the agreed-upon standard set out before work commenced. This can result in safety issues, which in turn may lead to legal disputes. Where building work has failed to meet required standards upon inspection, a lengthy period of time may be invested to identify who is at fault. 

Identifying the common causes of construction litigation may protect the interests of your business. If you feel that contractual obligations have been violated, then you may be entitled to pursue a legal claim for compensation.
