A contract breach can be complicated to sort out, but there are legal options. It starts with identifying exactly how the contract has been broken. From there, you can determine liability and connect that to any potential harm that was suffered.

Every situation is unique. However, the following are a few examples of ways that contracts are commonly breached.

Failure to perform

Perhaps the most common issue is simply when one party fails to perform in accordance with the contract. For instance, maybe your business hired an outside company to do your cleaning or window washing. They signed a contract to take on the job, but their crew never arrived and the cleaning was never completed.

A missed deadline

In other cases, the other party does technically adhere to the contract, but they miss a deadline while doing so. A common example of this is if you order parts and materials from an outside supplier. Your company anticipates getting the deliveries on a certain day to stay productive, but a supplier that misses that deadline has violated the contract.

Failure to pay

On the other side of the coin, some contract breaches simply involve nonpayment. Maybe you signed a contract with another company to deliver goods to their physical location. You made the drop-off, and they were supposed to wire you the money at the end of the day. But now it’s been three weeks, and you still haven’t been paid.
